Inspection
of the items will be held from 8:00 a.m. to 10:00 a.m. on
the day of the auction. The sale of the surplus items
will be open to the public. Please register promptly
when you arrive. At that time you will receive your
bidder number and a complete list of items being sold.
Items
must be paid for on the day of the auction. Business
checks, cash, cashiers checks, money orders and personal checks
will be accepted with two forms of proper identification.
Items must be removed from the Grounds before 3:00
p.m. on the day of the auction. MoDOT employees
will load items the day of the sale until 5:00 p.m.
Items left on the MoDOT lot after this time will not be the
responsibility of MoDOT .
If
you are disabled or have needs addressed by the ADA, contact
the above address or phone number at least 48 hours before
the auction date and time.

TERMS AND CONDITIONS
SUBMISSION
OF BIDS AND AWARDS
The
Auctioneer will offer each numbered item separately.
Bidders will communicate the amount of their bids either orally
or by such other means as may be recognized by and acceptable
to the Auctioneer. Unless otherwise provided in the
invitation, bid offers will not be recognized from any person
not properly registered.
All
items cataloged by weight, count or measure will be sold in
like units unless specifically changed by announcement of
the Auctioneer. The Department reserves the right to
sell in such units or groups thereof as it deems most expedient.
Items will not be subdivided or grouped unless a specific
announcement is made.
The
Auctioneer's "knocking down" an item will constitute an award
by the Missouri Department of Transportation - General Services
Official to the successful bidder for each item except as
otherwise herein specifically provided.
In
the event of a dispute as to the amount bid, item or item
number, Missouri Department of Transportation - General Services
Official reserves the right to reoffer the item in question.
Once an item is "knocked down", the bidder may not
withdraw the bid.
Records
of the State, certified by the Missouri Department of Transportation
- General Services Official as to the name and number of the
Bidder, the bid, and amount thereof shall be prima facie evidence
of the circumstances of the sale, and all disagreements will
be resolved in accordance with such records.
Special
provisions made by the Bidder will not be acceptable and will
be cause for the rejection of bids. All Bidders acknowledge
(by registering) that they have full and complete understanding
of these terms and conditions, and agree to be bound thereby.
Bids
will not be accepted from any person under the age of 18 years.
The
Missouri Department of Transportation reserves the right to
accept or reject any or all items.
PAYMENT
Full
Payment must be made before, but no later than, 1:00 p.m.
day of the sale. ITEMS WILL BE PAID FOR BEFORE REMOVING
THEM FROM THE PREMISES.
Business
checks, cash, cashiers checks, money orders, and personal
checks accepted with two forms of proper identification.
Titles will be filled out in compliance with Department of
Revenue regulations at the time of payment.
REMOVAL
OF EQUIPMENT
Items
must be paid for and removed from the premises before 3:00
p.m. on the day of the auction OR MAKE ARRANGEMENTS WITH KURT
GROENDA.
IMPORTANT
NOTICE TO ALL BIDDERS : You are cautioned
to bid only on those items you are prepared to pay for and
remove in accordance with the terms and conditions of the
auction. All items awarded to you as the high bidder
are contractually yours and must be paid for and removed within
the time period allowed by this notification. The Bidder
agrees that in the event she/he fails to pay for the property
or remove the same within the prescribed period of time, the
Department at its election and upon notice of default shall
be entitled to retain (or collect) as liquidated damages,
a sum equal to the greater of (a) 20% of the total purchase
price of the item(s) as to which the default has occurred
or (b) $25.00 or the purchase price of such item(s) if the
purchase price is less than $25.00. Failure to remove
items awarded will be cause for removal of bidder from bidders
list for future sales.
SPECIAL
CONDITIONS
The
Missouri Department of Transportation reserves the right to
accept any and all bids . State employees
are eligible to bid for themselves. All vehicles were
purchased by the Commission and have been used solely in Department
operations. Everything is sold "as is - where
is" without warranty or other representation as
to condition. Description is general and believed to
be correct, however, it is the Buyer's responsibility
to examine and inspect preceding the sale.
